A BILL to amend article eight-f, chapter sixty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section nine, relating to prohibiting a person who has been convicted of a sexual offense from subsequently changing his or her name; and exceptions.

Be it enacted by the Legislature of West Virginia:
That article eight-f, chapter sixty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section nine, to read as follows:
ARTICLE 8F. SEX OFFENDER REGISTRATION ACT.
§61-8F-9. Change of name prohibited; exceptions.
Notwithstanding any other provision of this code to the contrary, no person who is subject to the provisions of this article may, within ten years of registering under the provisions of section two of this article, file a petition to change his or her name: Provided, That if the person so registered applies to the division of corrections and establishes good cause, the division may waive the prohibition contained in this section.

NOTE: The purpose of this bill is to prohibit a person who is required to register as a sex offender from changing his or her name during the time he or she is required to maintain his or her registration.

JUDICIARY COMMITTEE AMENDMENT

On page two, line three, following the period, by inserting the following: "Violation of this section by obtaining a change of name constitutes a violation of the provisions of section six, article five, chapter forty-eight of this code."
